These Terms and Conditions (the "Terms") constitute a legally binding agreement between you (the "Customer") and AutoCare Solutions, a car repair service located in Seattle, Washington. These Terms govern your use of our services, including but not limited to car repair, maintenance, diagnostics, and any related services (the "Services"). By engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Customers may request Services by contacting AutoCare Solutions via phone, email, or in person. We will provide an estimate for the requested Services based on our initial assessment. Estimates are provided in good faith but are subject to change upon further inspection of the vehicle. We will obtain your approval for any changes to the estimate before proceeding with the work.
Payment for Services is due upon completion of the work, unless otherwise agreed upon in writing. We accept various forms of payment, including cash, credit cards (Visa, MasterCard, American Express), and debit cards. A late payment fee of 1.5% per month will be applied to any unpaid balances exceeding 30 days. In the event of non-payment, AutoCare Solutions reserves the right to pursue legal action to recover the outstanding balance, including all associated costs and fees.
AutoCare Solutions provides a warranty on all parts and labor for a period of 12 months or 12,000 miles, whichever comes first, from the date of service completion. This warranty covers defects in materials and workmanship under normal use and service. The warranty is void if the vehicle is subjected to misuse, neglect, accident, or unauthorized repairs. To make a warranty claim, the Customer must notify AutoCare Solutions promptly upon discovery of the defect and provide proof of the original service. AutoCare Solutions will, at its discretion, repair or replace the defective part or re-perform the defective service. This warranty is non-transferable and applies only to the original Customer.
AutoCare Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with our Services, even if we have been advised of the possibility of such damages. Our liability shall be limited to the amount paid by the Customer for the Services provided. We are not responsible for any loss or damage to personal belongings left in the vehicle during service. We recommend removing all valuables from the vehicle before leaving it with us.
The Customer is responsible for providing accurate information about the vehicle and the requested Services. The Customer must also notify AutoCare Solutions of any pre-existing conditions or issues with the vehicle. The Customer is responsible for ensuring that the vehicle is properly insured. The Customer is responsible for picking up the vehicle within a reasonable timeframe after being notified that the Services are complete. Storage fees may apply for vehicles left on our premises for an extended period.
Any disputes arising out of or relating to these Terms or our Services shall be resolved through good faith negotiation between the parties. If a resolution cannot be reached through negotiation, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Seattle, Washington. The decision of the arbitrator shall be final and binding on both parties. The cost of arbitration shall be shared equally by the parties, unless otherwise determined by the arbitrator.
AutoCare Solutions reserves the right to terminate the provision of Services to any Customer for any reason, including but not limited to non-payment, abusive behavior, or violation of these Terms. The Customer may terminate the service agreement at any time prior to the completion of the Services, subject to payment for any work already performed and materials used. Upon termination, the Customer is responsible for retrieving the vehicle from our premises promptly.
AutoCare Solutions reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. We encourage you to review these Terms periodically for any updates. Your continued use of our Services after any changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
AutoCare Solutions shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, fire, flood, strikes, labor disputes, or governmental regulations. In the event of a force majeure event, AutoCare Solutions will make reasonable efforts to resume performance as soon as practicable.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. The parties agree to negotiate in good faith to replace any invalid or unenforceable provision with a valid and enforceable provision that achieves the original intent of the parties.
These Terms constitute the entire agreement between the Customer and AutoCare Solutions with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties. No modification of these Terms shall be binding unless in writing and signed by both parties.

No waiver of any provision of these Terms shall be effective unless in writing and signed by the waiving party. No failure or delay by AutoCare Solutions in exercising any right, power, or remedy under these Terms shall operate as a waiver of such right, power, or remedy, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.
The Customer may not assign its rights or obligations under these Terms without the prior written consent of AutoCare Solutions. AutoCare Solutions may assign its rights or obligations under these Terms without the Customer's consent.
The headings in these Terms are for convenience only and shall not affect their interpretation.
